Yes and no.
You can upgrade a Jira Server with an expired licence. But only to versions that were released before the end of the licence.
If, for example, you are on Jira 9.0 and your licence expired June 30th, you would be able to upgrade to Jira 9.9.1 (released June 29th), but not Jira 9.10.0 (11th July)

As per the atlassian, Please upgrade the license before upgrading the Jira server.
you can upgrade with the using the free license but that is not suggested and It will impact after upgrade.
If you upgrade the license, then you will get support from the atlassian team during the upgrade If you faced any issue.
So please avoid to upgrade the Jira in the license expiration.
