Why does my mail handler sometimes use the person that sent the email as the reporter when I have got a set person for the reporter on the mail handler.

The email handlers try to match the sender of the incoming email to an existing account.  If they find someone with that email address, AND that account has "create issue" rights (or comment if it's a reply), then it creates (or comments) as that person, because it knows them.

I'd guess you have "create user automatically" turned off. 

The "default reporter" for the handler is "which user to create as if I cannot identify someone from their email, and I cannot create a new user, and if that account exists but cannot create (or comment)".
